During a Michigan divorce process, the CC 320 Financial Disclosure Form is crucial when both parties are required to provide a comprehensive account of their financial situation. This form is typically necessary after the plaintiff files a complaint for divorce and the defendant has submitted their initial response. At this stage, parties must exchange financial information to facilitate equitable division of assets and debts, and determine any support obligations.

Completing the CC 320 Financial Disclosure Form becomes mandatory unless both parties agree in writing to waive it or a settlement has already been reached. It helps define financial responsibilities and obligations by providing a clear view of income, expenses, assets, and debts, thus enabling judges and attorneys to proceed with informed decision-making.

Domestic Violence Exception
If you are a victim of domestic violence, sexual assault, or stalking, you can omit information that might reveal your location. However, you must provide a written statement with reasons for the omission filed with the court by the form's due date.
Unemployment Details
If you are unemployed and not receiving benefits, or only working part-time, provide detailed information about your last full-time job, including why you left, to explain any gaps in employment.
Income Supporting Documents
Attach your four most recent pay stubs and last year's tax returns. If self-employed, include the last three years of business tax returns. These documents substantiate your income claims in the form.
Real Estate Information
Include all properties you have an interest in, regardless of whether they are considered marital property or not. Provide accurate estimates for value, debt, and ownership interests.
Account Balances
List the balances of all financial accounts, including bank, retirement, and investment accounts, as of the date of filing. Provide details for both current balances and balances from 90 days prior to reflect any significant changes.
Life Insurance Policy
When listing life insurance policies, include employer-provided policies and note their taxable status. Ensure you describe both the cash/surrender value and the death benefit.
