Tips for filling out form UD-101

When completing form UD-101, pay special attention to these less obvious sections:

Item 1

Naming Defendants

Make sure to list each defendant's name accurately and completely. If you know the defendant by multiple names or aliases, include all known names.
Item 2a

Property Type

Even if the property is used for mixed purposes (e.g., residential and commercial), check both 'residential' and 'commercial' if applicable. This ensures that all relevant parts of the form are completed.
Item 3a

Rental Assistance Received

Include any financial compensation received from federal, state, local, or private sources, not just programs specifically titled as 'rental assistance.'
Item 3c

Pending Applications

Consider any application you have initiated but not yet completed as 'pending.' Even if you aren't sure if you'll receive assistance, disclose any ongoing application processes.
Item 4

Additional Allegations

This is an opportunity to include any unique circumstances or details that were not covered in previous sections. Consider using form MC-025 if you require additional space and reference it correctly.

What to do after filing form UD-101

Serve the UD-101 form and any attachments to the defendant along with the summons, as required by law.

If the summons has already been served without the UD-101 form, promptly serve the form by mail or another authorized method.

If the defendant has already answered the complaint, anticipate proceeding to trial without requiring a response to the supplemental allegations.

Prepare to file the Verification by Landlord Regarding Rental Assistance—Unlawful Detainer (form UD-120) if seeking a default judgment, ensuring all statements regarding rental assistance are accurate and complete.

Monitor any inquiries or communication from the court regarding the scheduling of further proceedings or hearings related to the unlawful detainer case.
